Holy Cross Hospital's MyHealth Terms and Conditions


By using MyHealth, including this website, you signify your assent to these Terms and Conditions. If you do not agree to all of these Terms and Conditions of use, do not use MyHealth!

Holy Cross Hospital Inc., (“Holy Cross Hospital,” “Holy Cross,” “we,” “our” or “us”) may revise and update these Terms and Conditions at any time and such modifications are effective immediately upon posting of the modified version. Your continued usage of MyHealth will mean you accept those changes.

“MyHealth” is an Internet application that enables a patient (“you” or “your”) to have secure web-based access to portions of their electronic medical record at Holy Cross. For the purposes of these Terms and Conditions, MyHealth includes the MyHealth website and all relevant parts and components thereto. MyHealth is not an attempt to practice medicine or provide specific medical advice and should not be used as a substitute for the advice of your personal physician or other qualified health care provider. Neither MyHealth nor any other application available through MyHealth is a substitute for appropriate and timely contact with your physician.
MyHealth is not a substitute for consultation with your physician. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her. You should not rely upon MyHealth if you have immediate, urgent or life-threatening health concerns or questions, but should instead seek appropriate emergency medical assistance, such as calling your doctor or 911.

The pages on the MyHealth website are subject to Holy Cross Hospital’s Website Disclaimer as set forth at http://www.holy-cross.com/disclaimer. Holy Cross will collect, access, safeguard, use or disclose your information through this portal only in accordance with applicable federal and state laws (such as HIPAA) and its internal policies and procedures, including in accordance with its Notice of Privacy Practices: copy of Holy Cross’ Notice of Privacy Practices


The security of any data in MyHealth is very important to us. We want your personal information to remain as secure as possible. MyHealth uses encryption technology designed to help ensure the integrity and privacy of the information you provide to us. As an added security precaution, all data is kept on servers with firewalls that meet or exceed industry standards to prevent intruders from gaining access.

We review our security practices on a regular basis to help ensure that your data is maintained securely and safeguarded in accordance with all applicable laws and regulations and our own internal policies and procedures. However, no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information. Moreover, when you transmit information via the Internet, your transmission may be compromised before it reaches us. Accordingly, Holy Cross makes no guarantee as to confidentiality or security of the data you submit or transmit via the Internet, including while using MyHealth. In addition, you hereby expressly and fully assume the risk of any unauthorized disclosure or intentional intrusion, or of any delay, failure, interruption or corruption of data or other information transmitted in connection with your use of MyHealth.

Disclaimer of Warranties
Holy Cross makes no express or implied warranties as to the accuracy, timeliness, merchantability, fitness or appropriateness for a particular use, purpose, title or non-infringement concerning your use of MyHealth. There is no warranty that the information on MyHealth or Holy Cross’ efforts will fulfill any of your particular purposes or needs. MyHealth and information contained in MyHealth are provided on an “as is” basis and the entire risk as to your reliance on information obtained from, or contained in, MyHealth are entirely on you. Holy Cross is not responsible for errors or omissions in the information contained in MyHealth.

You acknowledge and agree that Holy Cross does not operate or control the Internet and, therefore, cannot guarantee that the use of MyHealth will be error free or free from technology downtimes or unavailability. You further acknowledge that Holy Cross cannot and does not guarantee against any potential loss or damage to your data or the data you transmit via MyHealth due to viruses, worms or other unauthorized users or hackers attempting to obtain access to MyHealth or information transmitted to or from MyHealth.

Limitation of liability
The use of MyHealth is entirely at your own risk. Except as otherwise provided in this agreement, under no circumstances shall Holy Cross be liable to you or any third party for any damages (including, without limitation, direct, incidental, special, indirect, exemplary, punitive, consequential damages, personal injury, wrongful death or lost profits, including all fees and penalties), that arise under, result from or relate to these Terms and Conditions or the use of or inability to use MyHealth, or your use of data posted on MyHealth and connectivity to and from MyHealth to any other site, whether based on warranty, contract, tort, or any other legal theory, even if Holy Cross  has been advised of the possibility of such damages. In the event that the applicable state law(s) prohibit a full disclaimer of damages and liability above, Holy Cross shall be liable only to the extent of actual, direct damages incurred by you, not to exceed Five Hundred Dollars ($500). Any claims arising in connection with your use of MyHealth must be brought within one (1) year of the date of the event giving rise to such action occurred. Remedies under these Terms and Conditions are exclusive and are limited to those expressly provided for in these Terms and Conditions.

You assume the sole risk of transmitting your information as it relates to the uses of MyHealth and for any data corruptions, intentional interceptions, intrusions or unauthorized access to information, or of any delays, interruptions to, or failures preventing the use of MyHealth. You agree to defend, indemnify, and hold Holy Cross, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.

Through MyHealth, we may provide access to other websites for your convenience. Holy Cross Hospital is not responsible for the availability, accuracy, or content of those external sites, nor does it endorse them.

User Responsibilities
1. You need to be an informed user of MyHealth. Please read our policies in full so you know how MyHealth works and how you interact with MyHealth.

2. Your login name and password are the keys to protecting the confidentiality of your information. It is your responsibility to keep your password confidential. It is only known by you and can be changed online at any time solely by you. Your password is not known by anyone at Holy Cross Hospital.

3. You must be age 18 or older to request a personal account to use MyHealth.

4. You agree that the information you provide in connection with your online services account is true and accurate and pertains to yourself or to someone for whom you are authorized to represent in connection with their medical care.

5. You will not use your MyHealth access for any illegal purpose or in a manner which violates local, state, national or international laws.

6. You will not use your MyHealth account to post or transmit material that may infringe or violate any rights of any party or is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful or embarrassing to any other person or entity.

7. You will not use your MyHealth access to attempt to disable, hack or otherwise interfere with the proper functioning of MyHealth.

8. If you choose to print your information from MyHealth, you are solely and entirely responsible for the privacy and security of that information.

Dispute Resolution
You agree that any dispute or claim (including personal injury claims) related to your use of MyHealth or any website or application accessed via your online services account associated with MyHealth is subject to the exclusive jurisdiction of the state of Florida and that any such dispute shall be governed by the laws of the state of Florida. This agreement also applies to anyone claiming on your behalf.

Discontinuation of Service
MyHealth is provided by Holy Cross Hospital as a courtesy to you. Holy Cross Hospital reserves the right to terminate, modify or discontinue (temporarily or permanently) your online services account and any application or website accessed via this account, at any time, with or without notice. In addition, Holy Cross Hospital may terminate, modify or limit your online services account or access to any website or application based on your online services account if you violate the terms of this agreement, you violate any law or if we determine, for any other reason, that it is no longer appropriate for you to use the online services account or access certain services using your online services account. You can unsubscribe from your use of MyHealth at anytime by completing the appropriate online request.

Copyright and Trademark
Any material on MyHealth and all information available for download is the property of Holy Cross Hospital, Inc.  and/or its subsidiaries and affiliates, and is protected by copyright law. Unless otherwise stated, users may print, copy electronically or download information from MyHealth for personal, non-commercial use only, provided they identify the source of the material and include a statement that the materials are protected by copyright law. Permission to reprint or otherwise reproduce any document in whole or in part is prohibited, unless prior written consent is obtained from the copyright owner.

The trademarks, copyrights, names, logos and servicemarks (collectively "trademarks") displayed on MyHealth are registered and/or protected trademarks of Holy Cross Hospital’s and may not be distributed, modified, reproduced, or used, in whole or in part, without the prior written consent of Holy Cross. The content, documents, forms, photographs, images and illustrations, podcasts, videos, audio, blogs and user comments on the MyHealth website are the property of Holy Cross or their respective owners. Any reproduction or redistribution of this material beyond personal use is prohibited without the express written consent of Holy Cross.

Holy Cross hereby grants you a nonexclusive license to use MyHealth solely for your personal, non-commercial use and not to use the Site to obtain materials or data for any other purpose. As a condition of your use of MyHealth, you warrant to Holy Cross that you will not use MyHealth for any purpose that is unlawful or prohibited by these Terms and Conditions. If you breach any of these Terms and Conditions, your authorization to use MyHealth will automatically terminate. Any rights not expressly granted by these Terms and Conditions or any applicable end user license agreements are reserved by Holy Cross.
